Bylaw enforcement

The Local Government Act and the Community Charter authorize the RDCO to enact a bylaw and provide enforcement using regulatory offence tickets. For full details on bylaws we enforce and the associated fines see Bylaw Notice Enforcement | Bylaw No. 1538.

Register a complaint

Bylaws are not enforced pro-actively. Your concerns or complaints must be reported to initiate enforcement. RDCO Bylaw Officers respond to complaints Monday to Friday, 8 a.m. to 4 p.m.

It is helpful to include any or all of the following:

  • Civic address or best detailed description of problem location.
  • Any owner or occupier information (if known).
  • Your specific concern.
  • Your name, address and phone number (this is only for the inspector to contact you for further information – your personal information is never given out).

How to pay tickets and fines

If a ticket is not paid, not disputed or an adjudication hearing has not been requested within 14 days, the opportunity to dispute the is lost and the penalty will immediately become due and payable to the Regional District. Please ensure prompt payment.

If after 14 days a ticket has not been paid and a request for adjudication has not been made, a letter will be sent providing a final opportunity to pay. If payment is not received after a further 28 days, the ticket may be forwarded for collection and/or court action.

Payment options

A credit card processing fee of 3% will be added to payments over $1,000 paid by credit card, as per Miscellaneous Fees and Charges | Bylaw No. 1425. Alternate payment methods are outlined below.

  • Pay online: pay your bill anytime online using Visa or Mastercard at payments.rdco.com.
    • You must login or create a payment account to use the online system. Once you are logged in, search by your issued ticket number and the year, located at the top of the paper ticket notice.
    • It may take 2 to 3 business days for a ticket to be entered into our online system. If you see an error message "No record found" please try again in a few days. If the ticket number is still not found, please contact us for assistance. 
  • Pay in-person: visit our office at 1450 KLO Road during business hours (Monday to Friday, 8 a.m. to 4 p.m.) and speak with the cashier. 
    • Bring your paper ticket and payment. We accept payments by cash, credit, debit, cheque, money order or bank draft.
  • Pay by mail: include your paper ticket and payment (cheque, money order or bank draft) made payable to "Regional District of Central Okanagan." Do not send cash in the mail. Address the envelope to:

    • Postmarks are not accepted as proof of date of payment, so please ensure payment is delivered before the payment due date. Additional charges will apply to NSF cheques. Invalid cheques will not be considered payment before the due date.
  • Drop-off a cheque/money order: use the secure drop box at our main door outside business hours or anytime. 
    • Include your paper ticket and payment of cheque, money order or bank draft in a sealed envelope and drop it into the deposit box.
  • Pay utility bills through your bank: some bills can be paid through your bank–reach out to your banking institution for more information. The Regional District is registered with most financial institutions in BC for online and telephone banking. Search for the biller name "Central Okanagan."

Regulatory offence tickets

RDCO Bylaw officers can issue two types of regulatory offence tickets: Bylaw Offence Ticket and Municipal Ticket Information. Payment options for each type of ticket are the same (online, in-person, drop box and mail. Dispute options for each type of ticket are different.

Bylaw Offence ticket system

The RDCO is part of the Southern Interior Bylaw Adjudication Program. We are partnered with the City of Kelowna, Lake Country, Peachland, West Kelowna, Oliver, Penticton, the Regional District of Okanagan Similkameen, Summerland and Vernon. This is a simpler, quicker and less costly method of resolving minor bylaw infractions and disputes that otherwise could end up in the Provincial and Supreme Court system.

All RDCO bylaws are included in the Bylaw Dispute Adjudication Program except those involving Aggressive and Dangerous Dog incidents, which are often more complex, require a higher burden of proof and may result in stricter measures of control through the court system.

Through the Bylaw Adjudication Program, the process of disputing a Bylaw Offence Notice could possibly be resolved in one month. The Bylaw Adjudication Program provides an alternative resolution process but doesn't replace the existing Municipal Ticketing Infraction (MTI) system.

Anyone that's received a Bylaw Notice has the opportunity to dispute violations outside the court system. This is done through an independent adjudicator who will hear all disputes.

Disputes will be handled in a 3-step process

  1. After the Regional District receives the Dispute/Request for Adjudication, one of the RDCO's appointed Screening Officers will review the incident. The Screening Officer will contact the ticket holder or person disputing the Bylaw Notice to present their side of the incident. The Screening Officer will then review the Bylaw Notice and either revoke or uphold the notice. If the notice is upheld, the person disputing the ticket may choose to either pay the fine or request that the notice go to an adjudicator.
  2. If the person disputing the Bylaw Notice chooses the adjudication process, they will be contacted by a Dispute Coordinator who will confirm the file is complete and will request additional information if needed. An adjudication date will be scheduled based on the Adjudication Calendar and the Dispute Coordinator will confirm the preferred method of participation: in person, by phone or in writing.
  3. A date and time for the adjudication will be provided to the disputant. Most hearings will be conducted at Kelowna City Hall, 1435 Water Street. Kelowna, B.C. V1Y 1J4 (or an alternate location) and the disputant will be advised. The person disputing the Bylaw Notice and the Bylaw Officer are not required to appear in person. Representation for the disputant may be made in writing or over the phone. Documentation from the Regional District may be presented in support of the notice.

Independent adjudicators will determine whether a bylaw infraction did or did not occur. If the Adjudicator determines the infraction occurred, the full penalty will be applied as well as an adjudication fee of $25. If the Adjudicator determines that no infraction occurred, no fine will be applied. The Adjudicator does not have the authority to modify the offence or the penalty.

Municipal ticket information system

The Province of BC introduced “Municipal ticketing” (also called Municipal Ticketing Information system or MTI) to enable prosecution by local governments of local government bylaws. This process is used for offences that are deemed more serious in nature, that should be resolved in a Court of Law as opposed to an Adjudication Forum. MTIs can take six months to multiple years to reach a resolution.

Prosecutions under the MTI system follow the criminal burden of proof and carry higher penalty amounts.

It will be forwarded to the Kelowna Courthouse to be scheduled for a hearing. If you fail to appear for the hearing it will be deemed convicted in your absence.
